Terms and conditions

Flinders University operating as Flinders University Museum of Art (FUMA) grants the Applicant a non-exclusive, limited licence to reproduce and distribute the image(s) (Image) described in the Application form. The Applicant shall not assign, transfer or sub-let its rights under this Agreement to any other party.
FUMA will provide the Applicant with a digital file containing photographic material of the Image (Image Material) suitable for reproduction. The Image Material remains the property of FUMA and after using the Image Material for the reproduction permitted under this Agreement the Applicant shall not access or use the Image Material for any other purpose. Any subsequent use of the Image Material for reproduction requires a new application. If digital files are not downloaded by the Applicant within the 30-day expiry date, an additional administrative fee will be charged and payable prior to re-releasing image.
Where FUMA does not own copyright in the Image in accordance with Australian law, FUMA will notify the Applicant. The Applicant must provide FUMA with proof of permission to reproduce and publish the Image from the prime copyright owner before the Image Material is provided. FUMA will assist where possible in supplying the Applicant with any details of the prime copyright owner.
Images must not be cropped, overprinted, altered or defaced without prior approval by FUMA or the copyright owner. Applications to reproduce the Material with alterations will be considered if the Licensee presents a realistic sketch or mock up of the proposed alteration.
A fee for the supply of Images will be quoted when the Application is processed. See Fee Schedule below for further details. Any Images requiring photography will incur an additional fee and may take up to 8 weeks to process. Fees are to be paid on invoice, which will be issued once the Agreement has been signed by FUMA. Images will be delivered to the Applicant once fees have been paid in full.
Each image reproduction must be accompanied in close proximity by a caption supplied by FUMA. It is the responsibility of the Applicant to acknowledge artistic works in accordance with Australia’s Moral Rights and Copyright legislation.
Immediately upon publication, a free copy of the publication must be sent to Flinders University Museum of Art, GPO Box 2100, ADELAIDE SA 5001, AUSTRALIA.
FUMA reserves the right to refuse to supply Image Material or to revoke reproduction rights where the context or quality of the reproduction is deemed to be unsuitable, inappropriate or contrary to the artist’s or FUMA's interests.
This Agreement will be construed in accordance with the laws of the State of South Australia and the parties agree to submit to the jurisdictions of the courts of that State.

Administration fees

The Administration fee charged by Flinders University Museum of Art is separate to any copyright cost levied by the copyright owner.

Concessions will be considered for non-commercial projects.

Postage will only be charged if files are too large to send securely online.
